You must provide accurate and complete information to register for an account. You are responsible for all activities that occur under your account.

Use of the Software

Users must comply with all applicable laws and regulations when using the Software.
Users must provide accurate and up-to-date information when creating an account.
Users are responsible for maintaining the confidentiality of their account information and password.

License

We grant Users a limited, non-exclusive, non-transferable license to use the Software in accordance with these T&C.
Users may not distribute, modify, or create derivative works from the Software without our prior written consent.

Intellectual Property

All intellectual property rights in the Software and related materials are owned by us or our licensors.
Users may not use our trademarks, logos, or other proprietary information without our prior written consent.

User Conduct

Users agree not to use the Software for any unlawful purpose or in any way that could harm the Software or our reputation.
Users must not attempt to gain unauthorized access to the Software or its related systems.

Business Portal

Businesses will have access to a portal at business.bizreview.ai where they can customize the questions and responses to ask their customers.
Businesses can enter publicly available information about their business from Google.
Businesses can give permission to BizReview.ai to access Google Maps performance metrics, which will be used to measure the effectiveness of Google reviews on the business.

Content Ownership and Responsibility

The reviews generated through BizReview.ai are considered user-generated content. Neither the Business, BizReview.ai, nor the Customer owns the content.
BizReview.ai does not guarantee the originality, plagiarism-free nature, or adherence to copyright or trademark laws of the content generated.
BizReview.ai utilizes third-party APIs (e.g., OpenAI, Google Gemini, Claude, AWS Bedrock) to generate reviews and does not guarantee the accuracy or reliability of the content produced.

Accuracy

Artificial intelligence and machine learning are rapidly evolving fields. While we strive to improve our Services continually, the probabilistic nature of these technologies means that the use of our Services may result in output that does not accurately reflect real people, places, or facts. We do not guarantee the accuracy, reliability, or completeness of the reviews generated.

Subscription and Payment

Businesses will pay a monthly subscription fee that is auto-renewed every month.
Users can cancel the subscription at any time.
No refunds will be issued.

Usage Limitations

There is no restriction on the usage, but there is a threshold of 5 requests per minute. If this threshold is exceeded, the site will be temporarily unavailable.

Limitation of Liability and Indemnification

BizReview.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services.
Businesses agree to indemnify and hold BizReview.ai harmless from any claims, losses, liabilities, and expenses (including attorneys’ fees) arising from their use of the Software, violation of these T&C, or infringement of any third-party rights.

SMS Disclaimer Clause

By subscribing to BizReview.ai services, you agree to receive SMS notifications from us. These messages may include, but are not limited to:

  1. Subscription Expiry Reminders: Notifications about the upcoming expiration of your current subscription.
  2. Free Trial Expiry Reminders: Alerts regarding the end of your free trial period.
  3. Subscription Pricing Updates: Information and updates about subscription pricing and changes.

Key Points:

  • Opt-In Requirement: You must provide explicit consent to receive SMS notifications by opting in during the registration process.
  • Frequency: The frequency of SMS notifications will vary depending on your subscription status and account activity.
  • Opt-Out: You can opt-out of receiving SMS notifications at any time by following the instructions provided in the message or by contacting our customer support.
  • Carrier Charges: Standard message and data rates may apply based on your mobile carrier’s terms and conditions.

Changes to T&C

We reserve the right to modify these T&C at any time. Users will be notified of any changes, and continued use of the Software constitutes acceptance of the modified T&C.

Governing Law

These T&C are governed by the laws of the State of Delaware, United States. Any disputes arising from these T&C will be resolved in the courts of Delaware.
For users outside the United States, these T&C shall be construed under the laws of the United States and the state of Delaware, except where international laws take precedence.

Users are responsible for compliance with all applicable local laws and regulations. If using the Software outside of the United States, you agree to comply with all local laws and regulations regarding online conduct and acceptable content.
